This License Agreement (“Agreement”) governs the rights granted to users of imgvelix.com in respect of AI-generated images created through the Website. The Website is operated by LUVINDO LTD, Studio No. 12, 264 Lavender Hill, London, England, SW11 1LJ, registered in England and Wales under company number 17078430.
1. The Service
imgvelix.com allows users to generate images using artificial intelligence by spending Tokens purchased on the Website. This Agreement sets out the rights you receive in relation to those generated images.
2. Grant of Licence
Subject to your compliance with this Agreement and the Terms of Use, LUVINDO LTD grants you a non-exclusive, worldwide, paid digital licence to use, reproduce, modify, display, and distribute images you generate through the Website for both personal and commercial purposes.
This licence is granted per image at the time of generation and does not require any further payment beyond the Tokens used to create the image.
3. Restrictions
You must not use generated images: in a manner that violates any applicable law or regulation; to defame, harass, or harm any individual or group; to create deepfakes or misleading content presented as real; in any way that infringes the intellectual property or other rights of third parties; or in connection with unlawful goods or services.
You acknowledge that AI-generated images may inadvertently resemble real persons, existing artworks, or trademarks. You are solely responsible for ensuring that your use of generated images does not infringe any third-party rights.
4. Ownership of the Platform
All rights in the Website, the AI model, the software, and all underlying technology remain the exclusive property of LUVINDO LTD or its licensors. This Agreement does not transfer any ownership of the platform or its components to you.
5. No Warranty on Output
Images are generated by artificial intelligence and provided “as is”. LUVINDO LTD makes no representations or warranties regarding the originality, accuracy, quality, or fitness for purpose of any generated image. We do not guarantee that generated images will be free from third-party intellectual property claims.
6. Tokens — No Refund on Use
Tokens are consumed upon image generation. Once a Token has been used to generate an image, it cannot be refunded, regardless of whether the resulting image meets your expectations. Please refer to our Refund and Returns Policy for information on refunds for unused Tokens.
7. Termination
This licence in respect of any image terminates automatically if you use that image in breach of this Agreement. LUVINDO LTD reserves the right to suspend or terminate your account and revoke licences granted under this Agreement if you breach its terms.
8. Limitation of Liability
To the maximum extent permitted by law, LUVINDO LTD shall not be liable for any loss or damage arising from your use of generated images, including any third-party intellectual property claims arising from such use.
9. Governing Law
This Agreement is governed by the laws of England and Wales. Disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
